Property and Land Prices will fall sharply: If Demat scheme will be implemented

Real estate is already in the grip of recession. After the new law, there is a possibility of a sharp fall in the prices of land and houses. Real estate has declined by 20 to 35 percent since 2014. In the next one or two years, there may be a decline towards about 25 percent.

The central government is going to bring a new rule for opening real estate demat account soon. The Center is going to implement the Real Estate Demat Account Scheme for the entry of land and houses on the same lines as the demat account has been started for the stock market.

All the shares are recorded in the Equity Demat Account. Suppose Deepak Kumar has a demat account, then how many shares of which company he has, its full details remain. For example, Deepak has 140 shares of Reliance, 218 SBI and 250 shares of Sun Pharma, then full details will be recorded in his demat account. If Deepak sells 40 shares of Reliance, then only 100 shares will remain in his account. That is, the entire account of shares is recorded in the demat account. A person cannot buy or sell shares without opening a demat account.

Similarly, now all the details of land, house, shop, mall etc. will be recorded in the demat account. Who does not have a demat account, that person, firm or company cannot buy or sell land/house/shop etc. For example, if a person has a house in Jaipur, a residential plot in Noida, a shop in Poona, a commercial plot in Gurgaon, then all of them will have Indraj in the demat account. If the Indraj of any plot or house etc. is not in the demat account, then that property will be considered as illegal. Transaction of such property shall be void.

In the new law, there will also be a provision of fine for not using the vacant plot within the stipulated period. Apart from this, the people who will have benami property, the government will confiscate it. Under these circumstances, as soon as the new law is implemented, the possibility of a huge earthquake of slowdown in real estate cannot be ruled out.

Modi government is considering to implement this law soon.

रियल एस्टेट पहले से मंदी की चपेट में है। नए कानून के बाद जमीन और मकानों के भावों में भारी गिरावट आने की संभावना है। सन 2014 के बाद रियल एस्टेट में 20 से 35 फीसदी की गिरावट आ चुकी है। अगले एक-दो साल में करीब 25 प्रतिशत की ओर गिरावट आ सकती है।

केंद्र सरकार रियल एस्टेट डीमेट अकाउंट खोलने का शीघ्र नया नियम लाने जा रही है। जिस तरह शेयर मार्केट के लिए डीमेट अकाउंट प्रारम्भ किया गया है, उसी तर्ज पर जमीन और मकानों की प्रविष्टि के लिए केंद्र रियल एस्टेट डीमेट अकाउंट योजना लागू करने जा रही है।

इक्विटी डीमेट अकाउंट में सभी शेयरों का इंद्राज होता है। मान लीजिए दीपक कुमार का कोई डीमेट अकाउंट है तो उसके पास किस कम्पनी के कितने शेयर है, उसका पूरा ब्यौरा रहता है। उदाहरण के तौर पर दीपक के पास 140 शेयर रिलायंस, 218 एसबीआई और 250 शेयर सन फार्मा के है तो उसके डीमेट अकाउंट में पूर्ण विवरण दर्ज होगा । यदि दीपक ने 40 शेयर रिलायंस के बेच दिए तो उसके खाते में 100 शेयर ही इस कंपनी के शेष रहेंगे। यानी शेयरों का सारा हिसाब-किताब डीमेट अकाउंट में दर्ज होता है। डीमेट अकाउंट खुलवाए बिना कोई व्यक्ति शेयरों की खरीद-बिक्री नही कर सकता है।

इसी प्रकार अब जमीन, मकान, दुकान, मॉल आदि का समूचा ब्यौरा डीमेट अकाउंट में दर्ज होगा। जिसका डीमेट अकाउंट नही होगा, वह व्यक्ति, फर्म या कम्पनी आदि जमीन/मकान/दुकान आदि की खरीद-फरोख्त नही कर सकती है। उदाहरण के तौर पर किसी व्यक्ति के पास जयपुर में मकान, नोएडा में रिहायशी भूखण्ड, पूना में दुकान, गुड़गांव में वाणिज्यिक भूखण्ड है तो उन सभी का इंद्राज डीमेट अकाउंट में होगा। अगर किसी भूखण्ड या मकान आदि का इंद्राज डीमेट अकाउंट में नही है तो वह सम्पति गैर कानूनी समझी जाएगी। ऐसी सम्पति का लेन-देन करना अमान्य होगा।

नए कानून में निर्धारित अवधि में खाली भूखण्ड का उपयोग नही करने पर जुर्माने का भी प्रावधान होगा। इसके अतिरिक्त जिन लोगो के पास बेनामी जमीन-जायदाद होगी, सरकार उसको जब्त कर लेगी। 

इन परिस्थितियों में नया कानून लागू होते ही रियल एस्टेट में मंदी का बहुत बड़ा भूचाल आने की संभावनाओं से इनकार नही किया जा सकता है।

मोदी सरकार शीघ्र ही इस कानून को लागू करने पर विचार कर रही है
