The Supreme Court of India today took an important decision to constitute a five-member committee headed by Supreme Court Justice Abhay Manohar Sapre to investigate the Adani case. The names of other members of this committee are –

1. Shri OP Bhatt - Former Chairman of State Bank of India. Presently, Independent Director on the Boards of Oil and Natural Gas Corporation Limited (ONGC), Tata Steel Limited and Hindustan Unilever Limited (HUL).

2. Justice JP Deodhar - former judge of the Bombay High Court and former presiding officer of the Securities Appellate Tribunal.

3. Shri K.V. Kamat - former head of the New Development Bank of BRICS countries and former chairman of Infosys Limited.

4. Mr. Nandan Nilekani - Co-founder of Infosys, Former Chairman of UIDAI.

The subjects on which the committee has been asked to work will be as follows:

1. Provide an overall assessment of the factors and conditions that have led to volatility in the securities market now.

2. Suggest measures to increase investor awareness.

3. Examine whether there was a regulatory framework to deal with the alleged violations of law relating to the securities market by the Adani Group or other companies.

4. Suggest measures to strengthen the existing legal framework and regulatory framework for the protection of investors and to handle complaints in the existing framework.

The Supreme Court has requested the Chairman of SEBI to provide all the information to this committee. All the agencies of the Central Government have also been asked to cooperate with this committee. The committee is also free to take the help of other experts. The honorarium of the members of the committee will be decided by the chairman and the central government will bear it. The Secretary, Ministry of Finance, shall nominate a senior officer to act as a nodal officer for material mobilization for the Committee. All the expenses incurred in the work of the committee will be borne by the Central Government.

The committee has been asked to submit its report in a sealed cover to the Supreme Court within two months.

The Court has clarified that the constitution of the committee will not adversely affect the work of other regulatory agencies.

Simultaneously, the Court has also asked SEBI to complete its investigation in the Adani-Hindenburg matter within a period of two months and file a status report before the Court.

सुप्रीम कोर्ट ने आज अडानी मामले की जाँच के लिए सुप्रीम कोर्ट के न्यायाधीश अभय मनोहर सपरे की अध्यक्षता में पाँच सदस्यों की एक कमेटी के गठन का महत्वपूर्ण फ़ैसला लिया है । इस कमेटी के अन्य सदस्यों के नाम हैं -

1. श्री ओपी भट्ट - भारतीय स्टेट बैंक के पूर्व अध्यक्ष। वर्तमान में, तेल और प्राकृतिक गैस निगम लिमिटेड (ओएनजीसी), टाटा स्टील लिमिटेड और हिंदुस्तान यूनिलीवर लिमिटेड (एचयूएल) के बोर्ड में स्वतंत्र निदेशक।

2. न्यायमूर्ति जेपी देवधर - बॉम्बे उच्च न्यायालय के पूर्व न्यायाधीश और प्रतिभूति अपीलीय न्यायाधिकरण के पूर्व पीठासीन अधिकारी।

3. श्री के.वी. कामत - ब्रिक्स देशों के न्यू डेवलपमेंट बैंक के पूर्व प्रमुख और इन्फोसिस लिमिटेड के पूर्व अध्यक्ष।

4. श्री नंदन नीलेकणि - इन्फोसिस के सह-संस्थापक, यूआईडीएआई के पूर्व अध्यक्ष।

समिति को जिन विषयों पर काम करने के लिए कहा गया है, वह इस प्रकार होगा:

1. उन कारकों और स्थितियों का एक समग्र मूल्यांकन प्रदान करें जिनके कारण अभी प्रतिभूति बाजार में अस्थिरता आई है।

2. निवेशक जागरूकता बढ़ाने के उपायों का सुझाव दें ।

3. इस बात की जाँच करें कि अडानी समूह या अन्य कंपनियों के द्वारा प्रतिभूति बाजार से संबंधित कानून के कथित उल्लंघन से निपटने के लिए नियामक ढांचा था या नहीं ।

4. निवेशकों की सुरक्षा के लिए मौजूदा वैधानिक ढांचे और नियामक ढांचे को मजबूत करने और मौजूदा ढांचे में शिकायतों पर अमल के उपाय सुझाएँ ।

सुप्रीम कोर्ट ने सेबी के अध्यक्ष से इस समिति को सभी जानकारी प्रदान करने का अनुरोध किया है। केंद्र सरकार की सभी एजेंसियों को भी इस कमेटी से सहयोग के लिए कहा गया है । कमेटी अन्य विशेषज्ञों का सहारा लेने के लिए भी स्वतंत्र है। कमेटी के सदस्यों का मानदेय अध्यक्ष तय करेंगे और केंद्र सरकार उसका वहन करेगी । सचिव, वित्त मंत्रालय, एक वरिष्ठ अधिकारी को कमेटी के लिए सामग्री जुटाने के लिए एक नोडल अधिकारी के रूप में कार्य करने के लिए नामित करेगा। कमेटी के कार्य में होने वाला समस्त व्यय केन्द्र सरकार द्वारा वहन किया जायेगा।

कमेटी को दो महीने में अपनी रिपोर्ट सीलबंद लिफाफे में उच्चतम न्यायालय को सौंपने के लिए कहा गया है ।

न्यायालय ने स्पष्ट किया है कि कमेटी का गठन अन्य नियामक एजेंसियों के कामों पर प्रतिकूल प्रभाव नहीं डालेगा ।

इसके साथ ही, न्यायालय ने सेबी को भी दो महीने की अवधि के भीतर अडानी-हिंडनबर्ग मामले में अपनी जांच पूरी करने और अदालत के समक्ष एक स्थिति रिपोर्ट दाखिल करने के लिए कहा है ।
