A father's open letter to the CJI

Dear Honorable CJI,

I am writing to you today as a father whose son will be a year old the day after tomorrow, worried about the future of my children and the state of our democracy.

When you were appointed as the Chief Justice of India, there was a ray of hope that the judiciary would uphold the values enshrined in our Constitution and protect our democracy. Even though you have done great in making judicial service accessible to the people by focusing on the use of regional languages, however, after five months in office, not looking at contentious issues like Electoral Bonds, Jammu and Kashmir Reorganization Bill, and is disappointing.

Even more worrying is the lack of action against hate speech, both in the media and at political rallies.

It is well known that hate speech can lead to violence and destruction, yet it is prevalent in our society.

  Judiciary must take a firm stand against hate speech to protect the safety and dignity of all citizens.

When the migrant crisis was at its peak during the lockdown, the Supreme Court was sleeping when the Solicitor General lied to the court about the absence of migrants walking on the road. Judiciary has failed to protect the rights and welfare of the most vulnerable sections of the society.

Additionally, the Supreme Court allowed a split in the Shiv Sena, setting a dangerous precedent for the future of our democracy.

Moreover, the judiciary seems to be displaying a lack of fairness and propriety in its actions.

While a BJP MLA is granted bail, other political opponents are persecuted by the ED and CBI at the whims and fancies of the central government.

  Late Arun Jaitley famously said that retired judges are judged based on post-retirement benefits. When it comes to the opposition, the speeches given by the CJI regarding bail are not being followed by the lower courts.

Additionally, while the CJI had time for infamous journalist Arnab Goswami when it came to his detention, others who were victimized for political reasons were not given the same attention.

The Supreme Court is the guardian of the Constitution, and it cannot keep its eyes and ears shut when the political level-playing field is being leveled. Merely embellished speeches will not do.

The faith in the judiciary is falling fast because of the lack of backbone and propriety shown by the judges. It seems that the central government wants to exercise control over the appointment of judges and if the opposition is harassed for politics, it will come back to bite the judiciary as well.

• As a father, I worry about whether my children will grow up in a democracy or an autocracy?

• In a multicultural India or in an India where politicians decide what we wear, what we eat and who we love?

  The values of justice, democracy and individual liberty are vital to the future of our nation, and it is the responsibility of the judiciary to protect these values. The Constitution, the cornerstone of our democracy, must always be upheld.

As the Chief Justice of India, I urge upon you to take immediate and effective action to address these issues.

Judiciary must stand against hate speech and work towards maintaining the integrity of our democracy.

We need fair, impartial judges committed to upholding constitutional values. Let us not let the death of our judiciary be your legacy.

प्रिय माननीय सीजेआई,

मैं आज आपको एक पिता के रूप में लिख रहा हूं जिसका बेटा परसों एक साल का हो जाएगा, अपने बच्चों के भविष्य और हमारे लोकतंत्र की स्थिति के बारे में चिंतित होगा। 

जब आपको भारत के मुख्य न्यायाधीश के रूप में नियुक्त किया गया था, तब आशा की एक किरण दिखी थी कि न्यायपालिका हमारे संविधान में निहित मूल्यों को बनाए रखेगी और हमारे लोकतंत्र की रक्षा करेगी। भले ही आपने क्षेत्रीय भाषाओं के उपयोग पर ध्यान केंद्रित करके लोगों के लिए न्यायिक सेवा को सुलभ बनाने में बहुत अच्छा किया है, हालांकि, पांच महीने के कार्यकाल के बाद, चुनावी बांड, जम्मू और कश्मीर पुनर्गठन विधेयक, और जैसे विवादास्पद मुद्दों को न देखना निराशाजनक है।

मीडिया और राजनीतिक रैलियों दोनों में अभद्र भाषा - हेट स्पीच -  के खिलाफ कार्रवाई की कमी इससे भी अधिक चिंता का विषय है। 

यह सर्वविदित है कि अभद्र भाषा हिंसा और विनाश का कारण बन सकती है, फिर भी यह हमारे समाज में प्रचलित है।

 न्यायपालिका को सभी नागरिकों की सुरक्षा और सम्मान की रक्षा के लिए अभद्र भाषा के खिलाफ कड़ा रुख अपनाना चाहिए।

लॉकडाउन के दौरान जब प्रवासी संकट अपने चरम पर था, तब सुप्रीम कोर्ट सो रहा था जब सॉलिसिटर जनरल ने सड़क पर चलने वाले प्रवासियों की अनुपस्थिति के बारे में अदालत से झूठ बोला। न्यायपालिका समाज के सबसे कमजोर वर्गों के अधिकारों और कल्याण की रक्षा करने में विफल रही है। 

इसके अतिरिक्त, सर्वोच्च न्यायालय ने शिवसेना में  विभाजन को होने दिया, जिसने हमारे लोकतंत्र के भविष्य के लिए एक खतरनाक मिसाल कायम की।

इसके अलावा, न्यायपालिका अपने कार्यों में निष्पक्षता और औचित्य की कमी प्रदर्शित करती दिख रही है। 

जबकि एक भाजपा विधायक को जमानत दी जाती है, अन्य राजनीतिक विरोधियों को ईडी और सीबीआई द्वारा केंद्र सरकार की सनक और कल्पना पर सताया जाता है।

 स्वर्गीय अरुण जेटली ने प्रसिद्ध रूप से कहा कि सेवानिवृत्त न्यायाधीशों का निर्णय सेवानिवृत्ति के बाद के लाभों पर आधारित होता है। जब विपक्ष की बात आती है तो सीजेआई द्वारा जमानत के बारे में दिए गए भाषणों का निचली अदालतों द्वारा पालन नहीं किया जा रहा है। 

इसके अतिरिक्त, जबकि CJI के पास कुख्यात पत्रकार अर्नब गोस्वामी के लिए समय था, जब उनकी हिरासत की बात आई, तो राजनीतिक कारणों से शिकार हुए अन्य लोगों को उतना ध्यान नहीं दिया गया। 

सर्वोच्च न्यायालय संविधान का संरक्षक है, और जब राजनीतिक स्तर के खेल के मैदान को खत्म किया जा रहा है तो वह अपनी आंखें और कान बंद नहीं रख सकता है। केवल अलंकृत भाषणों से काम नहीं चलेगा।

न्यायपालिका में रीढ़ की कमी और न्यायाधीशों द्वारा दिखाए गए औचित्य के कारण विश्वास तेजी से गिर रहा है। ऐसा लगता है कि केंद्र सरकार जजों की नियुक्ति पर अपना नियंत्रण रखना चाहती है और यदि राजनीति के लिए विपक्ष को परेशान किया जाता है, तो वह न्यायपालिका को भी काटने के लिए वापस आ जाएगा। 

• एक पिता के रूप में, मुझे इस बात की चिंता है कि मेरे बच्चे लोकतंत्र में बड़े होंगे या निरंकुशता में?

• एक बहुसांस्कृतिक भारत में या ऐसे भारत में जहां राजनेता तय करेंगे कि हम क्या पहनें, क्या खाएं और हम किससे प्यार करें?

 न्याय, लोकतंत्र और व्यक्तिगत स्वतंत्रता के मूल्य हमारे राष्ट्र के भविष्य के लिए महत्वपूर्ण हैं, और इन मूल्यों की रक्षा करना न्यायपालिका की जिम्मेदारी है। संविधान, हमारे लोकतंत्र की आधारशिला, को हमेशा बरकरार रखा जाना चाहिए।

भारत के मुख्य न्यायाधीश के रूप में, मैं आपसे इन मुद्दों के समाधान के लिए तत्काल और प्रभावी कार्रवाई करने का आग्रह करता हूं। 

न्यायपालिका को अभद्र भाषा के खिलाफ खड़ा होना चाहिए और हमारे लोकतंत्र की अखंडता को बनाए रखने की दिशा में काम करना चाहिए। 

हमें संवैधानिक मूल्यों को बनाए रखने के लिए प्रतिबद्ध निष्पक्ष, निष्पक्ष न्यायाधीशों की आवश्यकता है। आइए हम अपनी न्यायपालिका की मृत्यु को आपकी विरासत न बनने दें।
